Proposed Amendments to Zoning and Subdivision and Land Development Ordinances

NOTICE
TO THE RESIDENTS OF MIDDLETOWN TOWNSHIP:

Notice is hereby given that the Board of Supervisors of Middletown Township, Bucks County, Commonwealth of Pennsylvania, will hold a public hearing, pursuant to the Municipalities Planning Code, on October 13, 2009, at 6:30 p.m. at the Township offices located at 3 Municipal Way, Langhorne, Pennsylvania 19047, for the purpose of informing and receiving public comment and to consider the enactment of the proposed amendment of the following sections of Ord. 91-16 dated March 26, 1991, the Middletown Township Zoning Ordinance, as amended, and Ord. 85-23, dated November 12, 1985, the Middletown Township Subdivision and Land Development Ordinance, as amended, as proposed to be codified in the pending adoption of the Code of the Township of Middletown, PA (the section numbers correspond to those in the proposed codification of the Township's ordinances):
Zoning Ordinance amendments:
A. § 500-6. Definitions. Add a definition for "Vacant Lot" - A lot on which no permanent building is erected.
B. § 500-42.C Performance standard subdivisions. Clarify "housing types."
B. § 500-93. Cellular telecommunications facility. Amend Subsection L to clarify the placement of cellular facilities on Township-owned property.
C. § 500-138. Nonconforming lots. Clarify application of these provisions to vacant lots. Add new subsection, § 500-138C to permit additions to existing buildings under certain circumstances.
Subdivision and Land Development Ordinance Amendments
A. §440-11 General. Amend §440-11.B clarify the need for complete applications and payment of fees and provide a procedure for incomplete applications. Amend §440-11.C to conform the provisions relating to Township decisions on proposed plans to the Municipalities Planning Code.
B. §440-13 Preliminary plan, major subdivision or land development. Amend §440-13.C (2) to require electronic copy of plan and paper copies at the discretion of the Township. Amend §440-13.C (5) to include zoning considerations in the Township Engineer's review of submissions.
C. §440-14 Final plan, major subdivision or land development. Amend §440-14.C (1) to require electronic copy of plan and paper copies at the discretion of the Township.
D. §440-15 Final plan, minor subdivision. Amend §440-15.C (2) to require electronic copy of plan and paper copies at the discretion of the Township.
E. §440-16 Lot line changes. Amend §440-16.C (2) to require electronic copy of plan and paper copies at the discretion of the Township.
A copy of the full text of the ordinance under consideration by the Board of Supervisors may be examined or obtained at the Middletown Township Municipal Building, 3 Municipal Way, Langhorne, Pennsylvania, 19047, or may be reviewed at the offices of the newspaper wherein this Notice is published or at the Bucks County Law Library, Courthouse, Doylestown, Pennsylvania 18901. Any persons wishing to be heard before the Board are invited to attend and participate in the aforesaid meeting as may be fitting and proper.
